General Terms and Conditions

Welcome to Hire Freelancer Pro (“the Platform”). The Platform connects clients seeking freelance services (“Clients”) with freelance professionals (“Freelancers”) seeking work in IT, Web Development and Design, Apps, and related technologies.  Please only register as a Freelancer if your expertise is in these fields and as a Client if you are seeking suitably qualified Freelancers.

The term “users” in the Terms and Conditions may relate to either or both Clients and Freelancers.

By using the Platform, you agree to comply with these General Terms and Conditions (“T&Cs”) as well as additional Terms and Conditions specific to your use of this website either as a Freelancer or as a Client. Please read them carefully before using the Platform.

  1. Account Registration

1.1. To use the Platform, you must register an account. You must provide accurate and complete information during the registration process. You must not misrepresent your identity, create a Hire Freelancer Pro profile for anyone other than yourself (a real person), or use or attempt to use another user’s account or information.

You are solely responsible for maintaining the confidentiality of your account credentials and all activities that occur under your account.

1.2. You must be at least 18 years old to use the Platform. If you are using the Platform on behalf of a company or organization, you represent that you have the authority to bind such entity to these T&Cs.

1.3. Your profile information, including your description, skills, location, etc., must be accurate and complete and may not be misleading, illegal, offensive or otherwise harmful. Hire Freelancer Pro asks users to go through a verification process in order to use the site including providing an image of an identity document and confirmation of address.

2. Services

2.1. Clients may post job listings and project descriptions on the Platform (“Projects”). Freelancers may submit proposals to provide services on these Projects (“Services”).

Freelancers may also offer services by advertising their expertise using a provided format to do so.

2.2. The Platform does not guarantee the quality, accuracy, or suitability of any Services provided by Freelancers. Clients are responsible for verifying the qualifications and credentials of Freelancers before hiring.

2.3. Freelancers are required to deliver Services in a professional and timely manner, adhering to the terms agreed upon with the Client. Hire Freelancer Pro provides both Chat and Messaging facilities to enable clients and freelancers to fully discuss and agree to requirements and timings prior to contracts being finalized.

2.4. Long Term Contracts:

Hire Freelancer Pro recognizes that some Clients may be seeking a Freelancer or a remote worker on a long term basis rather than just a “one-off task”.  We recommend you make use of our platform in order to access whether a Freelancer or Remote Worker has the skills and abilities needed to be engaged on a full-time contract.  By setting and paying for some initial tasks via our platform you can determine whether a Freelancer is a good fit for your business.

A Client can engage a Freelancer, and a Freelancer can accept a contract on a long term basis outside the platform with no costs involved for either party. However, the Wallet Payment System and dispute option will no longer apply.

We hope this may encourage Clients seeking longer term or full time contract Freelancers to utilize Hire Freelancer Pro as a means of recruitment with no costs involved and a paid trial period for potential Freelancer engagement.

3. Payments

Please refer to the Payment sections available in the Freelancers T&Cs and Client T&Cs sections relating to payments and the Wallet System.

4. Disputes and Refunds

4.1. In the event of a dispute between a Client and a Freelancer, the parties should first attempt to resolve the issue directly. If no resolution is reached, the Platform provides a dispute arbitration system as a means of resolving issues.

The Platform will review all the details of the original agreement including the job listing or Freelancer Service Offer as well as any messages exchanged between the parties and any final agreement by the Freelancer to accept the terms offered by the Client.

The outcome of this review will result in one of the following:

(a) If the Freelancer has completed all the requirements of the contract the payment due will be released to the Freelancer.

(b) If the work has not been carried out as stipulated in the contract or has resulted in damage to the Client’s project then the payment will be returned to the Client or made available for the Client to seek an alternative Freelancer.

(c) If it becomes evident that the Freelancer has completed some of the work involved in the contract but not completed all of the agreed works then a partial payment will be recommended to both parties as a means of settling the dispute.  Failing this Hire Freelancer Pro will make a judgment on the amount to be paid to the Freelancer and the balance refunded to the Client.

4.2. Both Freelancers and Clients accept that the above methods of dispute and refund are the only and final options available and in accepting these terms and conditions acknowledge their understanding and acceptance.

4.3.The Platform is not liable for any disputes, losses, or damages arising from transactions between Users. Users release the Platform from any claims, demands, or damages arising out of or related to such disputes.

4.4. The Platform may issue refunds in exceptional circumstances, subject to its sole discretion and in accordance with its refund policy.

4.5. The dispute arbitration option will not apply to any arrangement or contract agreed between a Freelancer and a Client outside of Hire Freelancer Pro. This specifically applies where no payment by a Client has been made to Hire Freelancer Pro and deposited in the appropriate Wallet.

5. Intellectual Property

5.1. Clients retain ownership of any intellectual property provided to Freelancers for the purpose of the Services.

5.2. Freelancers grant Clients a license to use the deliverables solely for the intended purpose of the Project.

5.3. By offering a service, the Freelancer undertakes that he/she has sufficient permissions, rights, and/or licenses to provide, sell or resell the service that is offered on Platform.

5.4. The Platform retains ownership of all intellectual property related to the Platform, including but not limited to its design, features, and functionality.

6. Prohibited Conduct

6.1. Users must not engage in any unlawful, abusive, harmful, or fraudulent activity on the Platform.

6.2. Users must not attempt to manipulate the Platform’s systems or data, interfere with other Users’ accounts, or violate any security measures.

6.3. The Platform reserves the right to suspend or terminate accounts found in violation of these T&Cs as well as those specific to Freelancers and Clients.

7. Privacy

7.1. The Platform collects and processes personal information in accordance with its Privacy Policy. By using the Platform, you consent to such data collection and processing practices.
